What is Renting Homes Act 2023?
The newly implemented Renting Homes Act in Wales aims to enhance the rental experience for tenants and improve management for both community and private landlords.
The legislation will become effective for all new rental agreements established as of December 1st, 2022, and all current rentals on June 1st, 2023.
Compliance with the law necessitates adjustments to rental contracts, property upkeep, and communication protocols.
The law primarily focuses on reinforcing regulations surrounding tenancy agreements, maintaining rental properties, and clear communication between landlords and tenants.
How Can Landlords Stay in Compliance?
Landlords must abide by the updated regulations for all tenancies falling under the Act. The Welsh government asserts that the new Act will streamline the process for landlords.

Changes in Tenancy Agreements
These contracts come in two variations, secure and standard, designed to cater to the specific needs of both private and community landlords.
The Welsh government has also set guidelines for details, such as:
- Contact details of tenants and landlords
- Responsibilities of landlords for repairs and property possession
- Expectations for communication on pet ownership
Landlords must provide either a paper or electronic copy of the occupation contract to new tenants within 14 days of the agreement. Existing tenancies will have a grace period of six months to receive the updated contract.
Changes in the Dissolution of Rental Agreement
For landlords seeking to regain possession of their rental property without any specific cause, a six-month notice period must be given to the tenant.
However, if a tenant violates their tenancy agreement, the landlord must provide a one-month notice period. In severe issues such as anti-social behaviour or unpaid rent, Landlords can shorten the required notice period.
Before issuing notice, landlords must register with Rent Smart Wales and adhere to deposit protection regulations. Furthermore, the eviction notice can only be given six months after the tenancy agreement begins.
Changes in Rental Property Maintenance
As per the newly implemented regulations, landlords must ensure that their rental properties meet habitability standards. This means the rental property should be “Fit for Human Habitation” (FFHH).
2023 Renting Homes Act entails:
- Conducting frequent electrical safety inspections
- Installing functioning carbon monoxide and smoke detectors
- Maintaining functional utilities such as water, gas, and electricity
